Terms of Service

1. Definitions

• "EverAfter", "we", "us" refers to the operators of the Platform.
• "User", "you" refers to any individual who creates an account on the Platform.
• "Guests" refers to individuals whose data is entered into the Platform by a User (e.g., wedding guests).
• "Content" refers to any data, photos, text, or other material you upload or create on the Platform.

2. Eligibility

You must be at least 18 years old to create an account and use the Platform. By registering, you confirm that you meet this requirement and that the information you provide is accurate and complete.

3. Account registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately if you suspect unauthorised access to your account. We reserve the right to suspend or terminate accounts that violate these Terms or are associated with fraudulent activity.

4. Plans and payments

EverAfter offers a free plan and paid plans. Pricing details are available on the pricing page.

• The Signature (€99) and Premium (€129) plans are one-time payments granting access for the duration of a single wedding project.
• The Professional plan (€199) is a recurring subscription billed annually.
• All payments are processed securely via Stripe. We do not store card details on our servers.
• Paid plans include a 30-day money-back guarantee. To request a refund, contact us within 30 days of purchase.
• Recurring subscriptions can be cancelled at any time from your billing dashboard. Cancellation takes effect at the end of the current billing period.

5. Acceptable use

You agree not to use the Platform to:

• Upload or share content that is unlawful, harmful, abusive, defamatory, or otherwise objectionable.
• Infringe the intellectual property rights of any third party.
• Collect or store personal data of your guests beyond what is reasonably necessary for your wedding event.
• Attempt to gain unauthorised access to any part of the Platform or its infrastructure.
• Use the Platform to send unsolicited commercial messages (spam).
• Resell, redistribute, or sublicence access to the Platform without our prior written consent.

6. Your content and data

You retain ownership of all content you upload to the Platform. By uploading content, you grant us a non-exclusive, royalty-free licence to store, process, and display your content solely for the purpose of providing the service to you. We will not use your content or your guests' data for any other purpose. You are responsible for ensuring that you have the right to collect and process the personal data of your guests in accordance with applicable law, including GDPR.

7. Intellectual property

All software, design, trademarks, and content on the Platform that are not user-generated content are owned by EverAfter or our licensors. You may not copy, reproduce, or create derivative works from Platform content without our express written permission.

8. Service availability

We aim to maintain high availability of the Platform but do not guarantee uninterrupted access. We may carry out maintenance, updates, or changes to the Platform at any time. We will endeavour to give advance notice of planned downtime where possible. We are not liable for any loss or inconvenience resulting from temporary unavailability of the Platform.

9. Disclaimer of warranties

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Platform will be error-free, secure, or meet your specific requirements. To the maximum extent permitted by law, we disclaim all implied warranties, including warranties of merchantability and fitness for a particular purpose.

10. Limitation of liability

To the fullest extent permitted by applicable law, EverAfter shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform. Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

You may delete your account at any time from your account settings. We may suspend or terminate your access if you violate these Terms, without prejudice to any other remedies available to us. Upon termination, your right to use the Platform ceases immediately. We will handle your data in accordance with our Privacy Policy.

12. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of the Republic of Cyprus. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Cyprus.

13. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date above and, where appropriate, by email. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
